The divorce
process in Singapore is broken down into two stages.
In stage
1 of the divorce
process in Singapore, the family court will decide if the marriage should be
terminated because the marriage has broken down irretrievably based on one of
the following grounds:[1]
Adultery
Unreasonable behaviour of the other party
Desertion for a continuous period of 2 years
Separation for
3 years if both parties agree to the divorce
Separation for 4 years if only 1 party agrees to the
divorce
Should
the court be satisfied that the marriage has indeed broken down irretrievably;
it will grant an interim judgment to the parties and deal with the ancillary
matters in stage 2 of the Divorce Process in Singapore. These
include division of matrimonial assets, custody, care and control of the
children of the marriage and maintenance for the wife and children.
Parties
will receive a final judgment at the conclusion of stage 2.
Collaborative
Family Law Practice
For parties in dispute, going to trial may be
inevitable. The litigation process may be a traumatic experience for parties,
since they may have to relive their marriage woes in court. Fighting it out in court, however,
is certainly not the only option. One may wish consider a relatively new
initiative known as “Collaborative
Family Practice”. The collaborative
family practice, as the name suggests,
focuses on collaboration. The scheme assists parties in reaching an agreement
before the commencement of trial. At present, there are 19 Collaborative Divorce Lawyers under the
scheme in Singapore. More information on the
collaborative family practice may be found
on the Singapore Mediation Centre’s website.
Ms Gloria James is one of those specially trained to
take up the appointment. As a collaborative
family lawyer, Ms James has extensive
experience in helping troubled couples through the difficult process of
divorce. She is also a trained mediator with the Singapore Mediation Centre.
